Duty of Care
Full definition — The duty of care requires board members to act with the level of competence and diligence that a reasonably prudent person would exercise in a similar position. This means attending meetings, reading materials before votes, asking questions, and making decisions based on adequate information. Negligence in this duty can make a board member personally liable for harm to the school.
Why It Matters
Board members who fail to stay informed or who rubber-stamp decisions without due diligence put the school at risk. Understanding this duty helps members recognize that active, engaged participation is a legal requirement, not optional.
